PART 1: SIMPLE SUMMARY
Welcome to Future Legacy Tutor Hub — where learning, trust, and convenience meet.
Please note:
Payments: Lessons are paid for upfront before tutoring begins.
Refunds: You are entitled to a 7-day money-back guarantee if you're not happy after the initial lesson.
Cancellations: A minimum notice period of 24 hours is required to cancel or reschedule a session.
Respect the process: Parents and instructors cannot bypass Future Legacy for one-off payments or reschedule sessions — that's a terms and trust breach.
Privacy: We protect your information in relation to the POPI Act and don't share your information without your consent.
By registering or paying, you agree to these Terms & Conditions.
PART 2: FULL TERMS & CONDITIONS
1. DEFINITIONS
"Future Legacy" means Future Legacy (Pty) Ltd, registration number 2023/003778/07, South Africa.
"Tutor" means any independent contractor who provides tutoring services via the Platform.
"Parent/Client" means the individual booking or purchasing tutoring services for themselves or their child.
"Platform" means the Future Legacy website (future-legacy.co.za) and its associated systems.
2. PAYMENT & REFUND POLICY
All sessions, subscriptions, or packages must be pre-paid using the secure online payment system.
Prices are in South African Rand (ZAR) and include VAT where applicable.
7-Day Money-Back Guarantee:
If you’re unhappy after your first session, notify us in writing within 7 days. Future Legacy will issue a full refund within 10 business days.
After 7 days, refunds are only issued in line with the Consumer Protection Act 68 of 2008 (CPA).
3. CANCELLATION & RESCHEDULING POLICY
3.1 Parent / Client Cancellation
Cancelations or rescheduling of sessions may be done by giving at least 24 hours' notice directly through the Platform or to the Tutor.
Less than 24 hours' notice will result in the session being forfeited and no refund will be issued, except in exceptional circumstances (at Future Legacy's discretion).
Repeated last-minute cancellations will lead to suspension of your account.
3.2 Tutor Cancelations
Tutors must provide at least 24 hours' notice if unable to attend a session.
Not informing so allows Future Legacy to:
Reassign the Parent to a different Tutor, or
Request the Tutor to do a make-up session free of charge.
Recurring cancellations without notice may result in the removal of the Tutor from the platform.
3.3 Technical or Connectivity Issues
In case of technical failures (e.g., load-shedding or internet outage) that interrupt a session, both parties should notify Future Legacy.
A new session will be organized at an appropriate time — no additional charges.
4. REQUIREMENT OF TRUST / CUTTING OUT FUTURE LEGACY
Future Legacy spends significant amounts of money on marketing, screening, and administration.
In order to protect this, all Clients and Tutors agree that:
You are not to bypass or attempt to bypass the Platform to arrange direct arrangements or payments outside Future Legacy.
If a Tutor or Client is found to have done so, the following applies:
Immediate suspension or account closure by Future Legacy;
An administrative charge of R5 000 (or the estimated value of 3 months of sessions, whichever is higher) becomes payable to Future Legacy as liquidated damages;
Future Legacy reserves the right to sue in law or in the civil courts for breach of contract
This paragraph is directed at encouraging good business practice and sustainability to all users of the Platform.
5. RELATIONSHIP BETWEEN PARTIES
Tutors are independent contractors and not employees of Future Legacy.
The tutoring arrangement is directly between the Parent/Client and Tutor.
Future Legacy is a facilitator only, operating the platform, marketing, and payment mechanisms.
6. PRIVACY & POPI ACT COMPLIANCE
Future Legacy complies with the Protection of Personal Information Act (POPIA).
We only store information required for delivering the service, such as contact information, student grade, and tutor qualifications.
We will never disclose your data without consent except when:
Is mandatory by law; or
Is required for safe payment processing.
You can request to view, modify, or erase your data at any time by sending an email to info@future-legacy.co.za.
7. SAFETY & CONDUCT
Communication and lesson planning should always be done through the official Future Legacy channels.
Tutors and Clients are expected to behave professionally and respectfully at all times.
Harassment, profanity, or hazardous behavior will be immediately suspended or referred to the relevant authorities.
Parents remain responsible for supervision of minors during web-based or in-person sessions.
8. LIMITATION OF LIABILITY
Future Legacy provides the website "as is" and makes no warranty of any specific academic result.
Future Legacy is not liable for:
Direct or indirect harm resulting from tutoring activities;
Personal injury or loss incurred while receiving lessons or in transit to lessons;
Connectivity issues or Tutor failure outside its power.
Nothing in the Terms removes liability required by South African law.
9. DISPUTE RESOLUTION
Disputes between Clients and Tutors should initially be referred directly to the notice of Future Legacy at support@future-legacy.co.za.
Future Legacy will seek to mediate in good faith within 10 business days.
If not resolved, controversies may be referred to arbitration in Johannesburg according to South African law of arbitration.
10. ELECTRONIC COMMUNICATIONS
Using the Platform constitutes consent to receive electronically notices, invoices, and other communications.
Those communications are in accordance with legal writing standards according to the Electronic Communications and Transactions Act (ECTA).
11. GOVERNING LAW
These Terms are governed by the law of the Republic of South Africa and any legal action will be brought in a South African court having jurisdiction over this matter.
